Effects of the Suspension of the Execution of the Sentence under Supervision

Abstract

In the framework of this paper, the analyzed institution is the suspension of the execution of the sentence under supervision, in comparison with all other institutions of the punishment to highlight its effectiveness in correcting the defendant's behavior, his reintegration into society according to existing social requirements in the context of an educated and civilized people, but also the effective support of the victim of the crime in order to repair the damage caused as a result of the violation of the social values achieved by the committed act or to compensate it satisfactorily, fairly and proportionally to the repercussions suffered as a result of the commission of the crime.

In order to carry out the juridical-social analysis in a complex way, a series of scientific research methods were used, such as the logical method, through the legal perspectives and interpretations deduced in the work, the comparative method, by making a comparison between the institutions of the application of punishment, but also of the sources and the jurisprudence identified in the specialized field, the sociological method, consisting in the fact that the institution of punishment directly influences social life and interpersonal relations, but also those established between the state and the citizen.
