Abstract

Both legally and factually, the minor lives with both parents, married or not, as long as they live together. After the separation of the parents, the minor will live with one of them, according to their agreement or, in the absence of this agreement, according to the order of the court.

It has been observed in the recent years that there has been an increase in the number of cases in which parents agree to an alternative home, confirmed by a notary or the court that establishes this alternative home, at the request of both parents or only one of them.

The material aims at making a brief analysis of these cases, with the advantages and disadvantages for the child and for the parents.
