Some Aspects of the Execution of Court Decisions regarding the Establishment of the Residence of Minors and the Exercise of the Right to Personal Ties with the Minor
Abstract
Having as a legal basis the provisions of art. 910-913 of the Code of Civil Procedure, in this paper we will analyze the factual situation, the evidence administered in such civil processes in which a parent requests the application of penalties, because the other parent of the child does not comply with the court decision either regarding the establishment of the minor's home, or regarding the visitation schedule. Finally, based on the cases presented and the legislation in the field, we will try to answer the questions: who benefits from the mechanism of penalties applied by the court? Does this mechanism lead to the closeness between the non-resident parent and the child or to the relaxation of relations between the child's parents?
